We at GoalMax Inc. believe that transparency is fundamental to any positive working relationship. We understand that you are trusting us with your valuable personal data and we want to be as transparent as possible about how we collect, use, share and store it when you use GoalMax Inc. devices, applications, software, APIs, products and services (the “Services”). GoalMax Inc. supports this Privacy Policy with individual players, academies, schools, universities, clubs, management, administration, medical staff, and institutions, the "Clients" or "Client".

GoalMax Inc. respects your privacy and is committed to full compliance with the privacy principles contained in the privacy laws and regulations where we do business. GoalMax Inc. is fully compliant with HIPAA and CCPA regulations in the U.S.A., and with GDPR in the EU and many other countries.

What do we mean by "personal information" and "biometric information"?

Personal information is any information about you that identifies you or by which your identity might be determined, such as your name, email, telephone number, location, password, D.O.B., club or association membership IDs or usernames, and payment information if required. Biometric information is any information about your health, such as height, weight, and any readings from the GoalMax Inc. “Services”, such as heart rate data, Oxygen level, Hydration level, and other raw data transmitted, and health data submitted by the Client such as Medical records, food, sleep and water logs, female health tracking, any communication between the athlete and the coach, manager, administrator or health professional, profile photo, and biography.

Information we receive from your use of GoalMax Inc. Services

GoalMax Inc. devices collect raw data to estimate certain metrics regarding your health and sporting activity and the relationships among them. Depending on the GoalMax Inc. device used and the contract, metrics include: Total Distance, Speed and Sprint Analysis, Metres/yards per Minute, Balance, Accelerations, Decelerations, Stress Load, Load Balance, Heart Rate, Heart Rate Zones, Oxygen level, Hydration level and Calories Used. Your GoalMax Inc. device will transmit the raw data to the GoalMax Inc. GoalMax Edge and the GoalMax Inc. Cloud. The Client will be able to view their current workout metrics on their App, depending on the contract. These measurement metrics and raw data are backed up to GoalMax Inc. servers. This back up enables the Client to track their progress and view their performance history

Usage Information

GoalMax Inc. Services collects certain usage data including cookies, and the Client’s interaction with GoalMax Services. Such as, when the User views content, installs applications, creates an account, pairs or otherwise interacts with or accesses GoalMax Inc. Services through the GoalMax Inc. device, GoalMax Inc. App or computer. This usage information will only be used for analysis purposes.

What information does GoalMax Inc. collect and why?

1. For Clients who use GoalMax Inc. Services, we collect your account details, payment information if relevant, club, academy, school or institutional information if relevant, and sports performance data during times when GoalMax Inc. Services are activated, or when the GoalMax Inc. device or App is paired with other wearable devices as permitted, including field location, speed and distance covered, and raw biometric data. Goalmax’s collection, processing and use of this information for the reasons stated in this Privacy Notice is a key part of the functionality of GoalMax Inc. Services, and without it GoalMax Inc. cannot be considered fully functional. In addition, GoalMax Inc. obtains specific consent to use Clients’ personal and biometric information for these purposes. If the Client fails to provide certain information when requested, GoalMax Inc. may not be able to perform the Services or fulfill the contract as agreed to by GoalMax Inc. and the Client.

2. For Clients whose information is processed by GoalMax Inc. Services, we only collect information as permitted by the Clients and/or individual athletes from the individual athletes. It is those individual athletes or Clients who determine what information we process from the athletes. Generally, this information about individual athletes concerns training and performance data including field location, speed, acceleration, distance covered, heart rate and player load, injury, any medical data provided. The information collected is authorized by the individual athletes and/or the Client, collected by the Client through the use of GoalMax Inc. Services, and is processed and used by GoalMax Inc. in accordance with the agreement between GoalMax Inc. and the Client. GoalMax Inc. collects and processes the information as it is necessary to perform our part of our contracts with our Clients. In addition, where our Clients have obtained individual athlete consent for GoalMax Inc. to use and process the information as described, that consent also becomes part of GoalMax’s basis to use and process this information.

3. For all other non-athlete users, such as coaches, management, administration, medical staff, suppliers, consultants and contractors etc., GoalMax Inc. and affiliates only collects the following information: name, contact details and any information relevant to our professional relationship with them. The legal basis for the collection, use, and processing of this information by GoalMax Inc. and affiliates is that we collect, use, and process the information as described above to perform the legitimate business of maintaining necessary Client information for the operations of GoalMax Inc. Services.

ABOUT US AND THIS PRIVACY NOTICE

GoalMax Inc. is responsible for deciding how we hold and use your personal and biometric information. We are required under data protection legislation to notify you of the information contained in this Privacy Notice. It is very important that you read this notice fully. We may also provide you with other Privacy Notices on specific occasions when we are collecting or processing personal information about you. Please read any such Privacy Notices that you receive from GoalMax Inc. so that you are aware of how and why we are using such information.

GoalMax Inc. reserves the right to update this Privacy Notice at any time. We may also notify you from time to time about the processing of your personal information. THERE ARE THREE THINGS THAT WE ASK YOU TO DO

1. Please read the Privacy Notice and Terms of Use. When you log in to GoalMax Inc., we ask you to confirm that you have read the Privacy Notice and that you agree to our Terms of Use. Youth players, under 18, must have a parent or guardian confirm that they have read the Privacy Notice and that they agree to our Terms of Use.

2. We ask you to verify your email address. We will send you (or youth player’s parent or guardian) a verification link to the email address supplied. We do this to make sure that your email address is not being misused and that you really are the person behind the email address you provided.

WHAT ARE THE CONSENTS THAT I NEED TO GIVE?

These consents are not only required in the data privacy regulations of many countries, but they also help you understand how we use your data.

There are FIVE mandatory consents

1. Consent to use your personal information: email, age and location. This is information that you give us when creating your GoalMax Inc. account. We use it to provide you with accurate personal calculations such as heart rate, speed, sprint, fatigue, calories burned, and all of the health and performance related metrics that we provide.

2. Consent to handle your biometric information. Together with personal data, biometric information makes up the data that the algorithms need to provide you, and your coach or other authorized user, with personalized calculations. For GoalMax Inc., biometric data refers to heart rate data, activity data, sleep data, speed and sprint - in other words, all the health and performance data that our products and Services collect from you.

3. Consent to transfer your data outside your home country. GoalMax Inc. is a global company that offers and supports services all around the world. Most of our customer data is hosted on servers located in the U.S., however, some monitoring and remote work is done elsewhere. We use highly reputable and secure world class data storage platforms. All the partners involved in providing GoalMax Inc. Services to our customers are chosen very carefully.

4. Consent from the parent or guardian of a youth player (under 18 years of age). GoalMax Inc. users who are under 18 years of age need consent from their parent or legal guardian to use GoalMax Inc. Services.

5. Consent to receive important updates. As a user of GoalMax Inc. Services, you may also receive important notices from us from time to time. These important notices relate to the use of GoalMax Inc. products and services and may contain essential information concerning our products and services. For this reason, it is not possible to opt out of receiving these notices. We also inform all GoalMax Inc. users, (including those who have opted out of marketing messages,) of any changes to our Terms of Use or Privacy Notice. These update messages may contain important information that applies to you so we hope you continue to read them.

This is a voluntary consent. If you choose not to give this consent, it will not affect your use of GoalMax Inc. Services

Consent to send marketing messages. GoalMax Inc. wants to bring to your attention new features and ways to get the most out of your GoalMax Inc. product, as well as inform you about new GoalMax Inc. products and exclusive offers to existing GoalMax Inc. users. You can withdraw this consent at any time and this will have no effect on your GoalMax Inc. Services or GoalMax Inc. account use.

How and when does GoalMax Inc. share and store your personal and biometric information?

All GoalMax Inc. Services data can be transferred, stored and accessed from our cloud infrastructure. When Client’s authorization is granted, this allows individual athletes, coaches, managers, administrators, clubs, academies, schools, federations and other authorized institutions access to the players’ performance data that they need 24/7 on different device platforms. APIs are provided to give third party applications closer integration with player data.

RETENTION OF YOUR PERSONAL DATA

We keep your account information, like your name, email address, and password, for as long as your account is in existence because we need it to operate your account. In some cases, when you give us information for a feature of the Services, we delete the data after it is no longer needed for the feature.
